Spain's anti-squatting law: what changes for property owners

Since 3 April 2025, Spain has applied a reform commonly known as the "anti-okupas" law, designed to tackle illegal property occupation more effectively. Its changes have a direct impact on property owners and investors.

What follows is a general explanation, based on the information we published at the time. Every case depends on its own circumstances, so if you are faced with a real occupation, speak to a lawyer as soon as possible.

Faster eviction procedures

The core of the reform is speeding up evictions. According to the information published, an owner whose home has been illegally occupied can expect a court response within roughly 15 days of filing a complaint, compared with the four to nine months that earlier procedures could take. Actual timescales may vary depending on the court and the case.

"Allanamiento de morada" and "usurpación"

The law distinguishes between two situations:

  • Allanamiento de morada (breaking into a dwelling): this applies when someone enters, without permission, a home that is the owner's main residence. If it is detected within the first 48 hours, the police can step in immediately and remove the occupants without a court order.
  • Usurpación (unlawful occupation): this is the occupation of a property that is not the owner's main residence, such as a holiday home or an empty property. It does not pose the same immediate risk to the owner, but the reform also speeds up eviction in these cases.

Tougher penalties

The reform makes the consequences harsher for people who illegally occupy a property. Depending on the circumstances, they may face higher fines and, where violence or criminal activity is involved, prison sentences. The aim is to deter anyone thinking of occupying a property.

Is the problem really that serious?

The media often highlight cases of squatting, but it helps to keep the issue in perspective: it affects a small share of the country's properties overall. Even so, for those affected the consequences are serious, which justifies more effective legal protection.
